Terms of Service
These Terms of Service ("Terms") apply to your use of rovmere.com (the "Website") and to your communications with Rovmere Solutions ("Rovmere Solutions," "we," "us," or "our"), including our consultation form, booking calendar, website chat, phone, text, and email. Rovmere Solutions is a sole proprietorship owned by Zachary Tasman.
By using the Website or contacting us through it, you agree to these Terms. If you do not agree, please do not use the Website. Paid work is covered by a separate written agreement, as explained in section 3.
1. Using the Website
You may use the Website to learn about our services, contact us, and book a consultation. You agree not to:
- submit false, misleading, or someone else's information;
- use the Website, form, or chat to send spam, unlawful content, malware, or anything harmful;
- try to gain unauthorized access to the Website, our systems, or the platforms we use;
- interfere with how the Website works, or overload it;
- scrape, copy, or collect content or data from the Website using automated tools without our written permission; or
- use the Website in any way that breaks the law.
We may change, suspend, or remove any part of the Website at any time.
2. Free consultations
Our Free Business Automation Consultation is free, and there is no obligation to buy anything. During the consultation we discuss your business and share general suggestions. We may decline or reschedule a consultation, and you may cancel or reschedule using the link in your confirmation or by contacting us.
Suggestions made during a consultation, in chat, or on the Website are general information based on what you tell us. They are not a binding offer, a guarantee, or legal, tax, accounting, or financial advice.
3. Quotes and service agreements
Nothing on the Website is a binding offer or a fixed price. We do not publish standard pricing. If you want to work with us, we will send you a quote or proposal. Any paid work is governed by the written quote, proposal, or service agreement you accept (your "Service Agreement"), which sets out the scope, fees, timelines, responsibilities, and any ongoing support. If a Service Agreement conflicts with these Terms, the Service Agreement controls for that work.
What we can build depends on your existing tools, phone and messaging setup, platform features, carrier and registration approvals, the access you give us, and testing. Timelines are estimates.
4. No guaranteed results
We work to set up useful, reliable systems, but we do not guarantee any particular result. This includes search engine rankings, website traffic, a number of leads or inquiries, bookings, sales, revenue, review ratings, or approval of any phone number, text messaging registration, or account by a third party.
Example screens, conversations, and workflows on the Website use fictional businesses and details. They are illustrations, not client results, and do not promise any outcome.
5. Third-party platforms and fees
Our services are built on and connect to third-party platforms, including HighLevel (also known as LeadConnector) and phone, text messaging, email, calendar, AI, payment, e-signature, review, and social media providers. These providers are independent of Rovmere Solutions. Their own terms, policies, and fees apply, including subscription, usage, messaging, phone number, registration, and payment processing fees.
We are not responsible for third-party platforms, including their outages, errors, feature changes, price changes, data handling, account suspensions, or registration decisions. Unless your Service Agreement says otherwise, third-party fees are your responsibility and are separate from our fees.
6. AI and automation limitations
Our website chat may be answered by an automated AI assistant, and the systems we set up for clients may include AI phone assistants, AI chat, and automated messages. Please understand that:
- AI and automated tools can misunderstand people, give incomplete or incorrect answers, or fail to respond, and can be affected by the third-party services they rely on.
- Replies from our website chat are general information, not a binding quote, agreement, or professional advice. Only a written Service Agreement binds us.
- AI tools are meant to support, not replace, human judgment. We set up handover rules and testing, but clients remain responsible for monitoring their systems, reviewing conversations, and stepping in when needed.
- Automated systems should not be relied on for emergencies or urgent, safety-critical communications.
7. Client responsibilities for messaging, calls, and consent
If you are a client, you are responsible for how your business uses the systems we set up, including the messages sent and calls made in your name. In particular, you are responsible for:
- getting and keeping records of any consent required before you call or text people, including prior express written consent for marketing texts and calls where the law requires it;
- complying with the Telephone Consumer Protection Act (TCPA), state telemarketing and texting laws, the CAN-SPAM Act, Do Not Call rules, quiet-hours rules, and any other laws that apply to your communications;
- following mobile carrier and industry rules for business texting, including A2P 10DLC registration requirements and CTIA guidelines, and giving accurate information for registration;
- honoring opt-out requests (such as STOP replies) promptly, and not messaging people who have opted out;
- complying with call recording and transcription consent laws, which in some states require the consent of everyone on the call, and with any laws requiring disclosure that a caller is speaking with an automated or AI system;
- having your own privacy policy and terms where required, and handling your customers' personal information lawfully;
- reviewing and approving the messages, scripts, greetings, and business information used in your systems, and making sure they are accurate and not misleading; and
- making sure that any review requests, reviews, and testimonials you use comply with the law, including Federal Trade Commission rules.
We may point out compliance concerns and may refuse to set up, or may pause, any message or campaign we believe is unlawful or breaks platform or carrier rules. However, we do not provide legal advice, and you should consult your own attorney about your obligations.
8. Intellectual property
The Website and its content, including text, graphics, design, and the Rovmere Solutions name and logo, belong to Rovmere Solutions or its licensors and are protected by law. You may view and print pages for your own personal or internal business use. You may not copy, republish, or use our content for commercial purposes without our written permission. Other company and product names on the Website belong to their owners and are used only to describe compatibility or services.
Ownership of work created for clients, and of client materials, is set out in the Service Agreement. You keep ownership of the information and materials you send us, and you give us permission to use them to respond to you and provide our services.
9. Disclaimers
The Website and its content are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We try to keep the Website accurate and available, but we do not promise that it will be error-free, secure, or uninterrupted, or that information on it is complete or current.
10. Limitation of liability
To the fullest extent allowed by law, Rovmere Solutions and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from or related to the Website, our website chat, a consultation, or these Terms, even if we were told such damages were possible.
To the fullest extent allowed by law, our total liability for any claim arising from or related to the Website, our website chat, a consultation, or these Terms will not exceed one hundred US dollars (US $100). Liability for paid services is governed by your Service Agreement.
Some states do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
11. Indemnity
To the extent allowed by law, you agree to defend, indemnify, and hold harmless Rovmere Solutions and its owner from any claims, losses, liabilities, fines, and expenses (including reasonable attorneys' fees) arising from your misuse of the Website, your breach of these Terms, your violation of any law or third-party right, or, if you are a client, the messages, calls, content, and consent practices of your business, including any claim under the TCPA or similar laws, except to the extent caused by our own wrongful conduct.
12. Governing law and disputes
These Terms are governed by the laws of the State of Massachusetts and applicable US federal law, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Website will be brought in the state or federal courts located in Massachusetts, and you and Rovmere Solutions agree to the jurisdiction of those courts. Before filing a claim, we each agree to try to resolve the dispute informally by contacting the other in writing and allowing 30 days to work it out.
13. Other terms
If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a part of these Terms, that is not a waiver. You may not transfer your rights under these Terms without our consent. These Terms, together with our Privacy Policy and any Service Agreement, are the entire agreement between you and us about their subject.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and change the effective date above. Changes apply from the date they are posted. If you keep using the Website after that, you accept the updated Terms. Changes do not affect a Service Agreement you have already signed unless you agree in writing.
